An affidavit is written evidence: a statement of facts that you swear or affirm is true. Courts and tribunals rely on affidavits instead of live testimony in many situations, so they have to be sworn properly, with every exhibit marked, before they can be filed.

Exhibits
If your affidavit refers to other documents (a letter, a bank statement, a photo), those become exhibits. Bring them attached in order. Each one gets an exhibit stamp and is signed when the affidavit is sworn. Missing or unmarked exhibits are one of the most common reasons a filing gets sent back.
Where it will be used
Affidavits for Alberta courts can be commissioned by a commissioner for oaths. If the affidavit is for a court or agency outside Alberta, it needs to be sworn before a notary public; tell us when you book.

Can you write my affidavit?
No. We commission affidavits but do not draft their content or give legal advice. For court matters, a lawyer or the court’s self-help resources can help you prepare it.
Do exhibits need to be originals?
Usually a copy is attached as the exhibit. Follow the court’s or recipient’s instructions, and bring originals if you have been asked to.
I made a mistake after the affidavit was sworn. Can I fix it?
Changes cannot be made to a sworn affidavit. You would swear a corrected affidavit, or initial corrections made before swearing.
Does everyone named in the affidavit need to attend?
Only the person making the affidavit (the deponent) signs and swears it. Anyone else making their own affidavit must attend for theirs.
